addition, ED agrees to the following conditions: 1) In developing
the combined OCR, OSEP, CCD special Education data collection for
the Year 2000, ED will investigate the feasibility of requiring
100% electronic response rate for that collection. 2) For the Year
2000 compliance report and future reports, ED will make an effort
to pretest (with a small number of respondents) any new questions
that ED intends to use but has not used in previous compliance
reports. 3) Prior to implementing in the field, ED will submit for
OMB review and files, the new ED 101 and 102 that incorporate all
the changes outlined in the 8/27 memo.

The Elementary and Secondary School
Civil Rights Compliance Report is the vehicle for the Office for
Civil Rights, U.S. Department of Education, to acquire source
material in the form of data and information regarding the civil
rights compliance issues in the Nation's public elementary and
secondary schools. Information from the E&S Compliance Report
is used by OCR field offices when they consider public school
districts for compliance reviews and as source material when civil
rights compliance investigations are conducted.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
