The restoration of federal firearms
rights is statutorily codified in 18 U.S.C. § 925(c) and protects
the Second Amendment right of the people to keep and bear arms.
There is, however, currently no workable mechanism for the Attorney
General to grant restoration. To determine if such relief should be
granted to an individual, the Attorney General, by statute, must
determine if “the circumstances regarding the disability, and the
applicant’s record and reputation, are such that the applicant will
not be likely to act in a manner dangerous to public safety and
that the granting of the relief would not be contrary to the public
interest.” The principal purpose for collecting this information is
to enable PARDON, on behalf of the Attorney General, to make such a
determination by processing applicants’ requests for relief from
federal firearm disabilities. The information is necessary to
verify applicants’ identities, conduct investigation of the
applicants’ backgrounds and criminal records, and ensure proper
record in the Federal Register and notification to the Federal
Bureau of Investigation and other law enforcement entities in the
event of the grant of restoration of firearms rights

Available information suggests
approximately 1 million people will complete the Application to
Restore Federal Firearms Rights annually. We estimate an average of
one hour for review and data entry of the information in the
application. Review and data entry will be performed by PARDON
employees and legal instrument examiners (OPM Series 0963) at the
GS-7 to GS-9 level. With an average hourly wage of $49.47
(rounded),2 the estimated annual cost to the federal government is
$49,473,407.
