months. Given ED's inability to seek public comment in advance due
to the urgent nature of CARES Act implementation, ED requests a
waiver from the requirement to publish notice in the Federal
Register seeking public comment during the period of OMB review. ED
will solicit public comment within a reasonable period, but not
later than May 30, 2020.

The Department of Education (the
Department) is requesting an emergency clearance to allow for
immediate outreach to IHEs to meet the requirements of the CARES
Act. Section 18004(a)(1) of the CARES Act, Pub. L. No. 116-136
(March 27, 2020), authorizes the Secretary of Education
(“Secretary”) to allocate formula grant funds to participating
institutions of higher educations (IHEs). Section 18004(c) of the
CARES Act allows the IHEs to use up to one-half of the total funds
received to cover any costs associated with the significant changes
to the delivery of instruction due to the coronavirus with specific
exceptions. This Certification and Agreement is separate from that
which was used for designating funds for emergency financial aid
grants to students, which is cleared under a separate emergency
clearance, 1801-0005.
Section 18004(a) of the
CARES Act states that, “The Secretary shall allocate funding under
this section as follows: (1) 90 percent to each institution of
higher education to prevent, prepare for, and respond to
coronavirus….” ED is requesting an emergency clearance to provide
emergency support to institutions of higher education (IHEs) and
carry out the requirements of the CARES Act. The Certification and
Agreement for which ED is requesting approval will be used by IHEs
to request the portion of their allocation designated for
institutional aid. This Certification and Agreement is separate
from that which was used to request the portion of their allocation
designated for emergency financial aid grants to students, which
has already been cleared under a separate emergency clearance,
1801-0005.
This is an emergency program
change due to a statutory change requiring a new collection. The
increase in burden on institutions is an estimated total 2,853
hours based on an estimated 5,705 respondents. The increase in
burden is due to a program change due to new statute.
