ALL FEDERALLY RECOGNIZED AMERICAN INDIAN AND ALASKA NATIVE TRIBES
FIVE-YEAR NOTIFICATION OF THE OPTION TO RECEIVE ADVANCE NOTIFICATION OF
CERTAIN SHIPMENTS OF IRRADIATED REACTOR FUEL AND NUCLEAR WASTE (STCXX-XXX)
Purpose: To provide notice of the opportunity to opt into the U.S. Nuclear Regulatory
Commission’s (NRC’s) advance notification program.
Background: The NRC has committed to contacting all Federally recognized American
Indian and Alaska Native Tribes every five years to determine interest in beginning or
continuing receipt of advance notification of certain shipments of irradiated reactor fuel and
nuclear waste, pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Sections
71.97 and 73.37, that are transported within or across Tribal reservations 1. The NRC
amended its regulations to require NRC licensees to provide advance notification to
participating Tribes.
Discussion: If your Tribe is interested in opting into the program, please contact the NRC
Tribal Liaison Program Manager, Nadiyah Morgan at Nadiyah.Morgan@nrc.gov,
Tribal_Outreach.Resource@nrc.gov, or 301-415-5836. The NRC Tribal Relations Team will
mail or email a letter detailing the information needed from the Tribal official. In summary, the
Tribal official would submit a letter with the following information:
1. Contact information for the notification designee, an alternate, and an emergency
response contact with the understanding that these individuals have a “need-to-know”
for this information and recognize that they may receive sensitive and/or safeguards
information that will need to be appropriately handled. Also of note, the NRC will
publish this contact information in a future Federal Register notice and on the NRC
website for access by licensees.
2. A written statement that certifies that each designee (1) has necessary protection
measures in place and will be implemented for safeguards, as described in
NUREG/BR-0362, “Protection of Safeguards Information: Requirements for Tribes
Participating in the Advance Notification of Irradiated Reactor Fuel Shipments”
(Agencywide Documents Access and Management System [ADAMS] Accession No.
ML12283A116) and (2) completed the self-directed course, “Safeguards Information
(SGI) Awareness Training” (ADAMS No. ML16083A340).

3. Confirmation that the NRC has accurately depicted the Tribal reservation boundaries
on a provided map.
For your convenience, enclosed is a list of Tribes that currently have NRC-approved
transportation routes that pass within or across their reservations. The NRC plans to continue
notifying any Tribe of new route approvals that pass within or across their reservation
boundaries.
If your Tribe has already opted into the program to receive notifications and you wish to
continue, there is no action required of you at this time. The NRC periodically contacts the
designated representative(s) to verify contact information. Participating Tribes are listed here:
