justification provided by ACF. ACF will immediately begin the
process of obtaining approval for this collection under the normal
process provided by the PRA. Additionally, OMB notes that the
burden change associated with this collection is explained in the

The form is used by states to report
expenditures under the temporary assistance for needy families
program. State agencies will use this form to report data on a
quarterly basis. The form provides data on financial disbursements,
obligations, and estimates, it provides states with a mechanism to
request program funding and certify the availability of state
matching funds. Failure to collect this data would seriously
compromise the administration for children and families' ability to
monitor expenditures. This form may also be used to prepare
congressional budget.
This is a request to use
emergency procedures under 5 CFR Part 1320.13 for the Temporary
Assistance for Needy Families (TANF) Quarterly Financial Report
(ACF-196, OMB Control Number 0970-0247). This has been approved
under the Paperwork Reduction Act and used for State financial
reporting since 2003. Authority to require financial reports is
contained in section 402 of the social Security Act, as amended by
Public Law 104-193, the Personal Responsibility and Work
Opportunity Reconciliation Act of 1996. Under The American Recovery
and Reinvestment Act of 2009, Pub. L. 111-5 (ARRA) funds were made
available to State TANF grantees. Data elements to capture this
information were added in 2009 and inadvertently removed in 2012.
It was subsequently learned from the HHS General Council that ARRA
TANF funds continue to be available to State TANF agencies until
all ARRA funds are expended. Therefore, States need to restore the
ARRA data elements to the TANF Quarterly Financial Report for
financial reporting. Under regulatory authority at 45 CFR Parts
265.3 through 265.9 States are required to report quarterly with
reports due within 45 days from the end of the quarter. ACF has
consulted with State TANF agencies and they have requested that the
currently approved ACF-196 be modified so that the reporting of
ARRA funds could be made. Therefore, it is requested that approval
be granted by March 15, 2013 due to the collection of ARRA data is
essential to the mission of the agency and the first calendar
quarter's data cannot be collected by following normal be acquired
by following normal clearance procedures. The March 15 date will
allow for the revised TANF financial report to be implemented in
the OLDC (On Line Data Collection) tool and States to begin
reporting by April 1, 2013.
