Justification for Non-Substantive Changes to the Collection



  • Change to the Collection: The Social Security Administration (SSA) is adding the following citations from the Code of Federal Regulations (CFR) to the collection: 20 CFR 404.1730(c)(2)(i), 404.1730(c)(2)(ii); 416.1530(c)(2)(i), and 416.1530(c)(2)(ii)


  • Justification: These additional CFR citations require SSA to (1) notify a claimant representative if we receive no fee request (SSA-1560-U4) within 60 days of the date of the notice of a favorable decision and (2) provide an opportunity for the representative to request an extension of time. We previously obtained approval for these CFR citations under OMB Control Number 0960-0745.


Until recently, SSA did not take into account that claimant representatives may submit Form SSA-1560-U5 even after the standard 60-day timeframe. We are correcting this omission here. In addition, due to an oversight, SSA did not previously include these citations in this Information Collection Request.


Upon OMB approval of this Change Request, SSA plans to discontinue the OMB clearance for 0960-0745. Therefore, ensuring we do not double-count the burden for these CFR citations. We do not anticipate any changes to the burden for this collection through the addition of these CFR citations.
