BLOOD DONOR LOCATOR SERVICE (BDLS)

A. Justification


  1. Introduction/Authoring Laws and Regulations - 42 USC 1320b-11 of the United States Code and section 1141(a) of the Social Security Act require the Commissioner of the Social Security Administration (SSA) to establish and direct a Blood Donor Locator Service (BDLS). These regulations also require participating state agencies to provide the BDLS with specific information on blood donors who have tested positive for human immunodeficiency virus (HIV). SSA has codified these laws under 20 CFR 401.200 of the Code of Federal Regulations.


  1. Description of Collection – Under this regulation, when blood donor facilities identify blood donations as HIV-positive, the overseeing state agency must provide the names and Social Security Numbers (SSN) of the affected donors to SSA’s BDLS. We use this information to furnish the state agencies with the blood donors’ address information to notify blood donors. Respondents are state agencies acting on behalf of blood donor facilities.


  1. Use of Information Technology to Collect the Information - The BDLS is a service mandated by Government regulation. SSA does not use a standardized form to collect the information. The agency is not planning an electronic version of the BDLS collection at this time since there are only 10 respondents. This is less than Government Paperwork Elimination Act plan cut-off of 50,000 respondents.


  1. Why We Cannot Use Duplicate Information - The nature of the information we are collecting and the manner in which we are collecting it preclude duplication. We do not use another collection instrument to obtain this or similar data.


  1. Minimizing Burden on Small Respondents - This collection does not significantly affect small businesses or other small entities.


  1. Consequence of Not Collecting Information or Collecting it Less Frequently – If we did not collect this information, we would be in violation of the law. In addition, we cannot collect this information less frequently because we only collect it as needed. There are no technical or legal obstacles to burden reduction.


  1. Special Circumstances - There are no special circumstances that would require us to conduct this information collection in a manner inconsistent with 5 CFR 1320.5.


  1. Solicitation of Public Comment and Other Consultations with the Public – SSA published the 60-day advance Federal Register Notice on August 10, 2012 at 77 FR 47908, and SSA has received no public comments. We published the 30-day Notice on October 24, 2012, at 77 FR 65044. If we receive any comments in response to the 30-day Notice, we will forward them to OMB. We did not consult with the public in the maintenance of this information collection.


  1. Payment or Gifts to Respondents - We do not provide payments or gifts to the respondents.


  1. Assurances of Confidentiality - We protect and hold confidential the information we collect in accordance with 42 U.S.C. 1306, 20 CFR 401 and 402, 5 U.S.C. 552 (Freedom of Information Act), 5 U.S.C. 552a (Privacy Act of 1974), and OMB Circular No. A-130.


  1. Justification for Sensitive Questions - The information required by this regulation is sensitive. As per the law and regulations, we maintain strict confidentiality during all phases of processing, and immediately destroy all records related to the BDLS requests after use by both SSA and requesters.


  1. Estimates of Public Reporting Burden - We estimate the 10 participating state agencies request BDLS an average of 5 times per year. The estimated average response time is 15 minutes, for a total of 13 burden hours. The total burden represents burden hours only. We did not calculate a separate cost burden.


  1. Annual Cost to the Respondents (Other) - This collection does not impose any known cost burden to the respondents.


  1. Annual Cost to Federal Government - The annual cost to the Federal Government is approximately $2,500. This estimate is a projection of the costs for collecting and processing the information.


  1. Program Changes or Adjustments to the Information Collection Request - There are no changes in the public reporting burden.


  1. Plans for Publication Information Collection Results - We will not publish the results of the information collection.


  1. Displaying the OMB Approval Expiration Date - We are not requesting an exception to the requirement to display the OMB approval expiration date.


  1. Exceptions to Certification Statement - We are not requesting an exception to the certification requirements at 5 CFR 1320.9 and related provisions at 5 CFR 1320.8(b)(3).


B. Collections of Information Employing Statistical Methods


We do not use statistical methods for this information collection.
