this time. This OMB action is not an approval to conduct or sponsor
an information collection under the Paperwork Reduction Act of
1995. The agency shall examine public comment in response to the
Notice of Proposed Rulemaking and will include in the supporting
statement of the next ICR, to be submitted to OMB at the final rule
stage, a description of how the agency has responded to any public
comments on the ICR. In addition, the agency will note for the
public in both the final rule and the supporting statement of the
next ICR that it had incorrectly identified that this ICR was a
revision in its NPRM, when in fact this ICR is a new collection.
This action has no effect on any current approvals. If OMB has
assigned this ICR a new OMB Control Number, the OMB Control Number
will not appear in the active inventory. For future submissions of
this information collection, reference the OMB Control Number
provided.

Section 212(a)(9)(B)(i)(I) and (II) of
the Immigration and Nationality Act (the Act) provide for the
inadmissibility of certain aliens who have accrued unlawful
presence in the United States. There is also a waiver provision
incorporated into section 212(a)(9)(B)(v) of the Act, which allows
the Secretary of Homeland Security to exercise discretion to waive
the unlawful presence grounds of inadmissibility on a case by case
basis. The information collection required on Provisional Unlawful
Presence Waivers of Inadmissibility for Certain Immediate
Relatives, Form I-601A, is necessary for U.S. Citizenship and
Immigration Services (USCIS) to determine whether the applicant
meets not only the requirements to participate in the streamlined
waiver process provided by regulation, but also whether the
applicant is eligible to receive the provisional waiver.
