The Social Security Act (Act) and the
Code of Federal Regulations provide that individuals receiving
spousal benefits and concurrently receiving a Government pension
based on earnings not covered by Social Security may have the
amount of their Social Security benefits reduced by two-thirds the
amount of their Government pension; otherwise know as the
Government Pension Offset provision. SSA uses Form SSA-3885 to
document such cases. The respondents are applicants for spouse's
Social Security benefits or beneficiaries who receive a spouse's
benefits.
