10 CFR Part 50 of the NRC's
regulations, "domestic Licensing of Production and Utilization
Facilities," specifies technical information and data to be
provided to the NRC or maintained by applicants and licensees so
that the NRC may make determinations necessary to protect the
health and safety of the public, in accordance with the Act. The
reporting and recordkeeping requirements contained in 10 CFR 50 are
mandatory for the affected licensees and applicants. The current
nonsubstantive change request seeks to adjust the hours for Part 50
(a reduction of 1,735 hours) due to a final rule incorporating
American Society of Mechanical Engineers (ASME) code cases into the
regulations by reference. Prior to publication of the rule, these
hours were reviewed by OMB as part of an insignificant burden
determination for the rule.
The burden adjustment in this
nonsubstantive change requests reflects two changes: 1) There is an
additional burden of 25 hours (5 hours each for 5 licensees) for
licensees who apply a particular code case (N-730) to maintain
records. 2) 10 CFR 50.55a(f)(5) and 10 CFR 50.55a(g)(5) allow
applicants to request relief from ASME Code requirements determined
to be impractical. NRC estimates that adoption of Code Cases listed
in the Regulatory Guides will reduce burden on all 104 reactors by
reducing the number of relief requests submitted. The Code Cases
will accommodate situations in which certain inspections or tests
cannot be conducted, without requiring the licensee to submit a
relief request to the NRC. The NRC estimates that the incorporation
of the Regulatory Guides included in this rule will reduce the
number of relief requests by 88 requests annually, at 20 hours per
request (a decrease of 1,760 hours). The total burden change for
the rule is a decrease of 1,735 hours (-1,760 hours + 25
hours).
