The FCC established final commercial
leased access rules in the Second Report and Order on
Reconsideration ("Second Report"), CS Docket No. 96-60, FCC 97-27,
released February 4, 1997. Among other things the Second Report
revised maximum rate formulas for use of full-time leased access
channels, maintained current rules for maximum part-time rates,
allowed resale of leased access time, stipulated that minority and
educational programming can not be a substitute for leased access
programming unless the tier had 50% or more subscriber penetration,
required operators to accept leased access .....
