Part 1 of the Federal Power Act (FPA)
gives the Commission authority to issue licenses for hydroelectric
project works on a non navigable commerce clause water. Persons
intending to construct a project must file a declaration of their
intention to do so with the Commission. The Commission investigates
the proposed construction and if it finds that "interstate or
foreign commerce" would be affected by the proposed constructed,
then the Commission will instruct the applicant to file for a
license before commencing construction. FERC staff use the
information to determine the jurisdiction over the proposed
project.
