February 1999. DOL will resubmit the package for PRA clearance,
including the required public comment periods, after one year of
implementation to determine whether experience with implementation
of the methylene chloride standard merits revising either the
burden estimates or provisions of the rule that impose burden.
Approval is based on DOL's response to the public comment received
by OMB on June 23, 1997 and which DOL addressed in its memorandum
to OMB of July 28, 1997. DOL/OSHA agrees to include in compliance
guidance materials that will be released about the MC standard
answers to several questions posed in the public comment received,
including 1) when periodic monitoring is required after a change in
workplace conditions, 2) the fact that a written compliance plan is
no longer necessary for businesses with fewer than 20 employees,
and 3) the fact that electronic retention and transmission of
records is acceptable. Last, DOL has agreed to extend the date on
which firms that under the rule were required to commence initial
monitoring from Aug. 7 to Sep. 7, to allow more time for transition
following the effectiveness of this provision that will result when
DOL publishes a notice of this clearance in the Federal
Register.

The purpose of this standard and its
information collection requirements is to provide protection for
employees from the health effects associated with occupational
exposure to methylene chloride. Employers are required to monitor
employee exposure; reduce employee exposures to within the
permissible exposure limits; and provide medical exams, training,
and other information.
