The rule would
appear to impose significant disclosure burdens on the regulated
entities, particularly smaller entities. OMB encourages the
Commission to take all practicable steps, consistent with the
applicable statute, to minimize these burdens. OMB has responded to
Commission staff requests that the request be given expedited
review in light of the statutory deadline. The burden estimate has
been also modified to reflect Commission staff reestimates.

The proposed rule requires certain
disclosures in connection with telephone sales and requires
telemarketers to retain certain records regarding advertising,
sales, and employees. The disclosures would provide consumers with
information necessary to make informed purchasing decisions. The
records would be available for inspection by the Commission and
other law enforcement personnel to determine compliance with the
rule.
