Pursuant ot
Section 1320.13 of the Paperwork Reduction Act, we have approved
the information collection in the interim final rule for one year
so that the agency an OMB can consider any public comments about
these requirements. Because statutory amendments have led to
substanti changes in the attestation procedures since the proposed
rule stage, the agency shall address in its final rule the
following issues: 1) Th agency shall demonstrate that the criteria
used to trigger waivers minimize the attestation paperwork burden
for facilities that use contract nurses. These criteria should be
designed to balance the pape work burden with the number of nurses
hired, so that the paperwork is not unduly burdensome for
facilities that use only small numbers of contract nurses. 2) The
agency shall consider whether the form is flex ible enough to allow
most employers simply to certify that they will meet the
attestation elements. (If employers have to check the "other"
category for certain elements, then they will incur substantially
more burden in explaining their choices.)
