SCHEDULED IN THE FY85 REGULATORY PROGRAM FOR THE PROMULGATION OF
THE FINAL RULE. THIS CLEARANCE IS CONDITIONED ON MSHA'S
RE-EXAMINATION OF THE REQUIREMENT THAT ALL EXISTING ROOF CONTROL
PLANS BE REVISED TO MEET THE REQUIREMENTS OF THE NEW SUBPART C AND
RESUBMITTED TO MSHA FOR APPROVAL. THIS REQUIREMENT MUST BE
COMPETELY JUSTIFIED IF IT IS INCLUDED IN THE FINAL RULE, AND
EVIDENCE SHOULD BE PRESENTED THAT MSHA HAS EXAMINED LESS BURDENSOME
ALTERNATIVES.

FALLS OF ROOF, FACE AND RIB CONTINUE
TO BE A LEADING CAUSE OF INJURIES AND DEATH IN UNDERGROUND COAL
MINES. ALL UNDERGROUND COAL MINE OPERATORS WOULD BE REQUIRED TO
DEVELOP AND SUBMIT ROOF CONTROL PLANS TO MSHA FOR EVALUATION AND
APPROVAL. THESE PLANS WOULD BE EVALUATED T DETERMINE IF THEY ARE
ADEQUATE FOR PREVAILING MINING CONDITIONS.
